This is the last Will Testament of me Harriet Guion the wife of Gardiner Henry Guion a Lieutenant in His Majestys Navy  ?  by the Settlement made on or previous to my Marriage with the said Gardiner Henry Guion bearing date the twenty seventh day of July One thousand eight hundred and two the Sum of four Thousand five hundred pounds therein mentioned to be invested in some Security or Securities of the Honorable the United Company of Merchants of England trading to the East Indies in the names of John Starey and Samuel Thompson or to have been remitted to the East Indies for that purpose was asigned unto John Holt and Richard Holt therin named amongst other trusts therein particularly mentioned. If all and every true Daughter and Daughters of the said Gardiner Henry Guion by me the said Harriet Guion shall depart this life under the age of Twenty one years without having been married with such (Executors?) hereby mentioned and all and every the Son and Sons of the said Gardiner Henry Guion by me shall depart this Life before the age of Twenty one years of age that the said John Holt and Richard Holt and the Survivor of them and Executors & Asignors shall stand and be possessed of any interest in the said principal Sum funds and Securities upon Trust to Convey assign and transfer the same in the amounts therein and herinafter mentioned that is to say If I shall be then living then unto me or as my Executors Administrators or Assigns direct or appoint

But In Case I shall be dead then unto such person or persons for such Estate or Estates Uses Interests and purposes and in such mentioned form as I shall by my last Will or Testament in writing or any writing purporting to be or in the nature of my last will and Testament is signed or published in the presence of Two or more Credible Witnesses notwithstanding my (?)  direct and appoint or by the said Settlement will appear on (?)  Being herunto has Proved. The said Harriet Guion do by this last will and testament in writing and which I declare so to be by me signed and published in the

presence of the two Credible persons whose Names are Hereunder written as cowitnesses to the signing and publishing hereof by me made signed and published in pursuance and execution of the said power and authority so to me given in and by the said Settlement and of all the powers and authorities me enabling them to direct and appoint that the said John Holt and Richard Holt or the Survivor of them and Executors abide or Asign shall and do as soon as may be after my decease call and receive the said four thousand five hundred pounds and all Dividends Interest and Produce that shall or may be therein arise or thereby and as they shall from time to time receive the same or any part thereof that they do in the first place Convey One hundred and five pounds of lawful Money of Great Britain part thereof unto my Brother in Law Captain Guion as a Token of my Respect for him for the many marks of fraternal attention that I have received from him and fifty two pounds Ten Shillings of like lawful Money of the part thereof unto the Reverend Francis Festing And then to pay assign and transfer one thousand five hundred pounds of like lawful Money other part thereof unto my Dear Husband Gardiner Henry Guion to and for his own proper use and benefit and in the next place do lay out and invest One thousand pounds of like lawful Money other part thereof in their names in some or one of the public Stocks and funds or in Rail at Government Security or Securities at Interest  and that they do stand and be posessed of such Stocks funds or Securities wherein or whereupon the said one thousand pounds shall so be laid out and invested In Trust providing Dividends and Interest thereof as and thereafter same shall from time to time become due and payable shall pay the same unto my dear and beloved Aunt Rachel Holt the wife of the said John Holt in remembrance of the great maternal Care and Attention she has always shown to me for and during the time of her natural life to and for her own use and benefit independent of and to be no ways subject or liable to the Debts Control or Accountability of her present or any future husband and to that End I do hereby declare that the Receipt or Receipts of the said Harriet Holt or of her person or persons as she by writing under

her own separate hand only and without her husband shall from time to time appoint to receive the same shall be sufficient Discharge or sufficient discharges to my said Trustees for so such Monies as shall be in sure Receipt or Receipts specified to be received and from and after the decease of the said Rachel Holt upon trust that they my said Trustees or the survivor of them and Executors or Administrators so assign or transfer and pay the Stocks funds and Securities wherein or whereon the said One thousand pounds shall be then invested unto such persons or person as she the said Rachel Holt shall by Deed or writing in her lifetime to be by her executed in the presence of and attested by two Credible witnesses or by her last will and Testament in writing or any such writing in the nature thereof or purporting so to be by her signed sealed published and declared in the presence or her life Number of witnesses shall therin direct or appoint and in benefit of and for want of order or direction or appointment or as to such part or parts thereof whereof no such order Direction or appointment shall be made or in case of such being made and not absolutely disposing of the same or the whole of the Interest therein then as and when the same shall End and determine and subject thereto Upon Trust to transfer assign and pay sure Stocks funds and Securities whereon wherein the said one thousand pounds shall be then invested to the next of kin of the said Rachel Holt and after payment of the said overall Sum of One hundred and five pounds and fifty two pounds Ten Shillings one thousand five hundred pounds and one thousand pounds I do direct my said Trustees to lay out and invest in the Names of my Executors hereinafter named one thousand five hundred pounds of lawful Money other part of the said four thousand five hundred pounds in the purchase of three pounds for Each Consolidated Bank Annuities or so keep and continue the same in the East Indies where the same monies at Interest and that they my said Executors and the Survivors and Survivor of them and Executors and Administrators do stand possessed of or interested in the three pounds per Each in Consolidated Bank Annuities so to be purchased In Trust to receive the Dividends & Interest thereof shall yearly as and when the same
shall from time to time come due and payable and that they do pay and apply such & all yearly dividends and Interest in manner following that is to say Twelve pounds ten Shillings part thereof during the life of my dear Aunt Ann Grindall Spinster to her my said Aunt for her Attention her care willingly shown me for and during the term of her Natural life to and for her own sole use and benefit five pounds five Shillings of the part of the said half yearly dividends and Interest of such trust for Bank Consolidated Annuities or such other funds wherein the same may be invested unto my Cousin Mary Ann Charlotte Maule for and during the time of her natural life to and for her sole use & benefit and the residue or Surplus of such Dividends and Interest as shall during the Lives of my said Aunt and Cousin as also those dividends and Interests herein they are entitled to during their lives & after the decease of both or either of them unto my said dear Husband for and during the term of his natural Life and from and after the demise of my said Husband But Eventually subject and liable to the payment of the aforesaid shares and proportion of the said Ann Grindall and Mary Ann Charlotte Maule respectively upon Trust to transfer and pay one third part of the said three pounds for  Each Consolidated Bank Annuities wherein the said last mentioned sum of One thousand five hundred pounds shall be invested in or shall remain as aforesaid unto the said John Holt and Richard Holt or the survivor of them and Executor or Administrators to for and upon such and the same Trusts as are therefore mentioned and referred to respecting the aforesaid sum of One thousand pounds therein before bequeathed to those aforesaid or such of the said Trusts as shall be then payable of taking effect and upon further Trust to transfer asign and pay out Money or half part of the said interest for Consolidated Bank Bond Annuities or the Stocks wherein the same shall then be at Securities unto Susan and Sara Holt the children of the said John and Rachel Holt or to the Survivor of them and the residue or remaining one sixth part of such for trust Bank annuities or the Stocks or Securities wherin the same shall then be I direct to fall into the Residue of what I may have to dispose of and I do direct that the said John Holt and Richard Holt and the survivor of them his Executors and administrators do pay and apply
all such Sum and Sums of Money as they or either of them shall or may actually receive within the first eighteen Months after my decease at or for Interest Dividends or Produce of the said four thousand five hundred pounds or any part thereof as part of the Residue of what I may have to dispose of and that all of other Sum or Sums of Money which they shall or may receive afterwards as or for such Interest Dividends or Produce as they shall or so distribute divide and pay unto or among the several persons herein before mentioned and the residue of what I have to dispose of in the proportions I have Thereinbefore and Thereinafter directed the said four thousand five hundred amongst them and all the Rest and Residue and Remainder of the said four Thousand five hundred pounds to be divided amongst them  and all other Sum and Sums of Money whatsoever and all other Money Estate and things real I have any Right or power whatever to dispose of I do order dispose direct limit and appoint the same and every part and parcel thereof to the payment of my just Debts & funeral Expenses and the Expenses of proving this my will and after payment thereof unto my dear Husband to and for his own use and benefit provided always and I do hereby declare that neither of them my said Executors and Trustees or the Survivors or Survivor of them his or their Executors or administrators shall be answerable or accountable for any more Money than they Either of them shall actually receive nor shall they be answerable or accountable the one for the other or of others of them his or their Acts Debts Receipts payments Executors or (?) but each of them for himself only and for his own separate Acts Debts Receipts Payments   Executors and (?) their joining in Receipts for conformity only notwithstanding, and that they my said Executors and Trustees and the Survivors & Survivor of them his Executors and Administrators shall and may in the first place and out of fees and Trust Monies and promises deduct and retain to themselves and themself respectively all such Costs Charges Damages and Expenses as they or either of them or may be put unto in about receiving or recovering the Trusts or Money in them reposed any or either of them or any relating thereto And I do hereby nominate and appoint my said dear Husband and his friend John Gilbert and my (2 words deleted)

John Holt Executors of this my will and hereby revoking all former and other wills & be at any time therefore made I do declare this paper writing to be found named in this and the five providing Sheets of paper to be my only last Will and Testament and to be made in pursuance & execution of the power and authority to me given & receive in and by the said (?) Settlement and all other powers and authorities me enabling thereto In receipt whereof I the said Harriet Guion the Testatrix have to this my last Will & Testament contained in Six Sheets of paper set my hand & Seal that is to say to the first five Sheets thereof set my hand and to the sixth and last sheet my hand and Seal the fifteenth day of July in the year of our Lord one thousand eight hundred and five [signed Harriet Guion (LG)] Signed Sealed Published and Declared by the said Harriet Guion the Testatrix as and for her last Will and Testament in the presence of us who in her presence at her request and in the presence of each other have hereunto subscribed our Hands as Witnesses [William Cox ------------ (Ge?) This Will was proved at London on the fourteenth day of August in the year of our Lord one thousand eight hundred and six before the worshipful Leonard Beaumont Burnaby Doctor of Laws Surrogate of The Right Honourable Sir (William regent Knight?)  Doctor of Laws Master Keeper or (Commisary?)  of the Prerogative Court of Canterbury lawfully Constituted by the oaths of Gardiner Henry Guion the husband of the Deceased  John Gilbert and John Holt the Executors named in the said will to whom administration was granted of all and singular the Goods chattels and Effects of the said Deceased they having been first sworn duly to administer.

 

This Will was proved at London on the Twenty sixth day of March in the year of our Lord one thousand eight hundred and seven before the Right Honourable Sir (William Regent Knight ?) Doctor of Laws Master Keeper at (Commisary?)  of the Prorogative Court of Canterbury lawfully Constituted by the oaths of Gardiner Henry Guion the Husband of the Deceased John Gilbert and John Holt the Executors named in the said will to whom (?) was granted them of all and singular the Goods Chattels and Credits of the said Deceased they having been first sworn duly to administer.

and Credits of the Deceased they having first been first sworn to (?) the said Gardiner Henry Guion and John Gilbert by Commision, and the said John Holt before the worshipful Samuel (Phare? Parsoun?) Doctor of Laws and Surrogate duly to administer. The probate of the wills of the said Deceased granted in the Month of August last to the Deceaseds Executors as of the Deceaseds Effects being under five thousand pounds having been first brought involuntarily and declared Null and void as by Acts of Court appear.
